Odenville officially terminates fire chief

ODENVILLE — The search for a new fire chief will begin after former Chief David Davis was terminated by the mayor.

At Monday’s council meeting, the City Council approved Mayor Rodney “Buck” Christian’s decision to terminate Davis by a 4-0 vote.

The termination follows an incident last month in which two premature stillborn fetuses were flushed down a toilet at an Odenville residence.

Christian placed Davis on administrative leave with pay following the July 23 incident, but decided three weeks later to terminate him.

“On Aug. 12, Davis was given a letter of termination by myself in the presence of Mayor Pro-Tem Jimmy Bailey,” Christian said. “In that letter, it plainly stated his right to a due process hearing before the mayor and council.”

Christian said he asked Davis to notify him within seven days if he wanted to pursue the hearing.

“Davis did not notify me within that time frame, therefore waiving his right to a due process hearing,” Christian said. “Basically, that means he was terminated as of Aug. 12.”

The mayor terminated Davis based on a section in the Code of Alabama.

At an Odenville Council meeting two weeks ago, firefighter/paramedic Jared Wyatt read from a prepared statement in support of Davis and said members of the Fire Department wanted him to remain as fire chief.

“The guidance, leadership and dedication he has provided to our department, without question, is second to none. His commitment to our community as a whole is an inspiration to every member, both paid and volunteer. He has given to this town more than can ever be repaid. And the only thing asked in return is to allow him to continue serving our community,” Wyatt read.

Davis, who was not at that the council meeting, said the following day he was touched by the outpouring of support.

“The Fire Department, my guys, you get a bond,” Davis said. “It’s more like a family. I didn’t ask them to do that. When I heard they were doing it, it meant a whole lot to me.”

Davis said there is a lot of love in the Fire Department.

“We are family and some of the younger volunteers are like my kids,” he said. “Some of the older ones are like my brothers and sisters. It’s a bond, and it’s very hard to explain. I appreciate what they did. I’m sure the mayor and council listened and saw the sincerity on Jared Wyatt’s face.”

St. Clair County Sheriff Terry Surles said after hearing an allegation that two fetuses were disposed of in a toilet, the Sheriff’s Department started an investigation “by going into the septic tank to recover the bodies.”

Surles said once their investigation is complete, they will turn over everything to a grand jury, which is expected to convene in October.

Two weeks ago, Davis said the day the incident occurred, he and the Regional Paramedic Services medic were the only two emergency workers on the scene.

“There were two of us there, and we followed protocol,” Davis said. “We followed the state protocol issued by the medic who was in charge at the scene.”

Christian said the search for a new fire chief will not be a fast process.

“We will search for a new fire chief within the Odenville Fire Department first,” he said.

At Monday’s meeting, Thomas Graves was named acting fire chief by the mayor.

Davis was not available for comment Monday.

The citizens should pack town hall out about the points i have made and try to get down to the reason for the Davis Burning and ask questions about the safety of the citizens when it comes down to the actions of the RPS medic that has yet to be named. This person may show up on the next emergency call and would you like for him/her to give medcial treatment to you or your family? One last note to the citizens, the question should also be asked why does the fire department not have the staff (PARAMEDICS) on duty 24hrs a day to cover the needs of the citizens.No one seems to ask the hard questions like staffing.If the department had the funds Davis would not have been alone on that call without a Medic from the fire department.Davis could only work with what the town gave him! People should get informed about what services they have. Again best wishes to Davis and his family. Also i would like to say we (The FIREFIGHTERS) are very sorry for the loss of the children and that no one with the Odenville Fire Department including the chief was trying to be disrespectful.I have 4 children and me and my wife have lost 1 because of a miscarriage. I fully understand the pain this causes.Please try to remember that we are here for you and that CHIEF Davis has children and as a EMT BASIC this may have been the first time to see and deal with this type of call.I have worked with Mr Davis on Medical calls and have seen the care he gives to the citizens of Odenville.I have been on the job for many yrs and i have not seen a person try to do above what is the norm than what i have seen from Chief Davis.He will also carry the pain of what occured on that day. He has helped many people in life or deayh calls and made a differance in many peoples lives.So again I'm very sorry for your loss.

I HAVE WORKED @ ODENVILLE FIRE AS A PART-TIME FF/MEDIC.I WORK 48 HR SHIFTS @ TWO DEPARTMENTS IN JEFFERSON COUNTY.I WOULD LIKE TO SAY THAT CHIEF DAVIS IS A VERY GOOD CHIEF AND LEADER.I UNDERSTAND HOW THIS MUST LOOK BUT I THINK THAT DAVIS MAY HAVE MADE AND ERROR IN JUDGEMENT BUT I WAS NOT ON THE CALL.I WOULD LIKE TO SEE WHAT THE AMBULANCE SERVICE HAS DONE TO THE MEDIC THAT WAS ON THE AMBULANCE.WE SEEM TO BE BURNING DAVIS BUT LETS STOP AND THINK!!! THE PARAMEDIC IS THE PERSON WHO ALLOWED THIS TO GO DOWN. WHY IS HIS/HER NAME NOT NOTED IN ANY OF THE COMMENTS GOING AROUND. HOW MANY TIMES ARE THEY GOING TO MAKE A SLOPPY DECICSION IN ODENVILLE. Let's see. Where to start. stclaircitizen your right, "sloppy decision". concerned citizen your wrong, there is no State of Alabama protocol for miscarriages. If a Paramedic tells an EMT to jump off a bridge, would he/she do it? I don't think so. Good thing the call in question wasn't on a bridge. The decision was wrong, the chief is gone, LET'S MOVE ON!!!!!!!!!

Yeah, I have heard from the beginning that Davis followed the order of the paramedic on the scene because Davis is only a basic emt. He makes decisions on fire scenes ONLY. He asked him what he was suppose to do and the paramedic told him, "There's nothing we can do except flush them." So, again I wonder why we haven't heard of the paramedic being reprimanded, written up, put on leave, or terminated because of his bad judgement? This goes to show just how unfair your people appointed to office can be.

I thought of this recently......In the movie, "A Few Good Men" with Tom Cruise & Jack Nicholson, there were two marines arrested for the death of a fellow marine. But, they were following the order of Col. Jessup, the person in charge. The marines couldn't understand why they were discharged from the service because they were simply following orders. But the only difference in what has happened with Chief Davis and with this movie is, that when all is said and done, the man (Col. Jessup) that gave the order admitted it and WAS arrested and suffered the consequences of issuing the order!

Now I know that there's a huge difference here because what he ordered caused death to another human being. But, the way the family, the mayor, the council members & the sheriff have acted, you'd think that Davis caused the death of these twins, which is NOT the case and we all know that.

Again, the person that gave Davis the order to flush the commode NEEDS TO SUFFER THE CONSEQUENCES, as well as Davis, otherwise, to many, it appears that the family and the sheriff made Davis a personal target. So I hope, for the sake of all involved, the right thing is done here.

DAVIS DID MAKE A BAD CALL TO FOLLOW THE ORDER GIVEN, BUT THE MAYOR MADE AN EVEN WORSE DECISION BY FIRING HIM. But it's obvious that Davis has more support then the mayor who needs to start looking for other employment as there's no doubt he will be voted out come election time.

Actually "stclaircitizen", until you are an EMT or a Medic on scene, you don't know what is considered a "sloppy decision". And in fact, I'm almost completely positive that you must not comprehend the fact that he didn't make the decision, he followed orders. And the higher orders followed protocol. The State of Alabama did not penalize nor pull his EMT license. So guess what that means? He followed protocol. No "sloppy decisions" about it.

David Davis is a fine man and you will not find a more righteous person. The mayor of Odenville and council are cowards and weasels for not allowing him to stay. Can we fire the mayor before election time for his job performance? I thought he used to volunteer at the department, sounds like he has forgotten what its all about. I pray for David and his family

The citizens of Odenville should be furious that this man, who loved his town and its people, lost his job over this. Hopefully they'll remember clearly come election time.

This is a sad day for Odenville. Thoughtless headlines and off-the-cuff comments to media exacerbated this situation. Why not have waited for the Grand Jury results? I've lived in St. Clair County a long time, and I can remember murders and mayhem in the distant past and recent past that, to me, were worse than this.

This, like I said before is a huge mistake. David was a great fire chief. He was well respected and loved by the firefighters. He will always be respected by me as well. The town of Odenville will not find a permanent chief that was as dedicated and loved as David.

Seems to me that when chief davis asked to speak with the council members before the monday night meeting, where firefighter/emt Wyatt spoke, that he felt that was his due process. He poured his heart out to the council. Since that did him no good, why go through it again just to to be told no!!!!!

I feel the council and mayor made a serious mistake in firing chief davis. but my prayers go out to the fire dept and whoever they hire as chief. may God bless the fire department for all they do...
