Former firefighters arraigned, trial date set

A tentative trial date was set for September for three former Whitney Junction volunteer firefighters indicted for the theft of fire department funds.

The defendants did not appear in court Wednesday after attorneys representing the three firefighters filed written waivers of arraignment.

St. Clair County Presiding Circuit Court Judge Jim Hill set a tentative trial date for Sept. 17.

According to court documents, a Northern Division St. Clair County grand jury indicted Brian Keith Barbee, 51, of Steele for first-degree theft of property by deception, first-degree theft of property and second-degree theft of property.

Robert Lee Bragg, 33, of Ashville was indicted for second-degree theft of property.

Jason Scott Jovzpary, 24, of Ashville was indicted for first-degree theft of property by deception and first-degree theft of property.

Assistant District Attorney Carol Boone said she could not comment on the state’s pending criminal case against the three defendants.

She said first-degree theft of property is a Class B felony and a defendant convicted of that charge could face two to 20 years in prison. Second-degree theft of property is a Class C felony and a defendant convicted of that charge could face one year and one day to 10 years in prison.
