His column, “Judicial activists in the Supreme Court,” (April 5) is a perfect example of his clueless left leaning thoughts. In his opinion as long as the Supreme Court is making left wing, radical, socialist decisions E. J. is happy and supports their decision whole-heartedly.
On the other hand let the Supreme Court lean to the right or heaven forbid, actually judge a law based on its constitutionality and little E. J. pulls out his conspiracy theorist pseudo identity and suddenly – judicial activists abound!
Well gee Mr. Clueless, did you not know one of the functions of the Supreme Court is to exercise judicial review determining the constitutionality of laws brought before or passed by the Legislative Branch to include those signed into law by the Executive Branch. Are you also unaware that if we go by the Constitution of the United States that the Judicial Branch is part of that old pesky “Separation of Powers” deal our founding fathers wrote into the Constitution.
Of course there are judicial activists on the Supreme Court as well as every other court in the United States.
Personally, I think it is way past time for all three branches to actually open up their old dusty copies of the Constitution and actually read it. They will find quite a number of existing laws do not meet the Constitutional litmus test.
